I just ran across Gaffer's thread here. The PUC has been toothless since around 1950, maybe before. CMP built a dam at Long Falls After the legislature passed a law giving CMP the power of eminent domain. The villages of Long Falls, Dead River, Bigelow and Flagstaff were flooded. Armed Pinkerton agents showed up, gave property owners checks and evicted the people. There is a book called "The Lost Villages of Flagstaff Lake".

I mention this because CMP (Now owned by a Spanish company) still has the power of eminent domain. By the way; when the waters of Flagstaff Lake stopped rising, they were four feet lower than J P Morgan's hunting camp. Then he had a fishing camp too.

Speaking of PUC toothlessness, John Baldacci's "backbone" of high speed internet goes through many Maine towns, but we cannot tap into it because it is owned by the state. So much for public/private partnerships.
